Draft Law on Recalling Member of Parliament Initiated by President to be Submitted to Parliament www.montsame.mn
The Chief of Staff of the Office of the President of Mongolia, Uilstuguldur Altankhuyag, announced today at a press conference at the State Palace that President Khurelsukh Ukhnaa has initiated a draft Law on Recalling a Member of Parliament and will submit it to Parliament.
He said that the purpose of the draft law is to implement the fundamental principles of the Constitution, safeguard Mongolia’s democratic parliamentary system, strengthen public oversight of Parliament, reinforce discipline and ethics, and uphold justice.
The draft law sets out the following grounds for recalling a Member of Parliament:
First, if a Member of Parliament commits an ethical violation, he or she will be held legally accountable.
Second, if a Member of Parliament breaks an oath or commits a serious violation, the matter will be reviewed by the Parliamentary Subcommittee on Ethics, and then discussed at a plenary session of the Parliament. The final decision on recalling the Member of Parliament will be made by the Constitutional Court.
Third, if a court’s final ruling confirms that a Member of Parliament has committed a crime, the Member will be recalled.
Fourth, accountability of political parties holding seats in Parliament will be strengthened. If a Member of Parliament elected through the party-list system commits a serious ethical violation, that Member will also be subject to recall.
Secretary of the National Security Council Byambajargal Altangerel noted that the 1992 Constitution grants the Constitutional Court the authority to decide on the recall of a Member of Parliament. The 2019 constitutional amendments also included grounds for recalling a Member of Parliament; however, the specific procedures and stages of the recall process have remained unclear.
He emphasized that the draft law initiated by the President will aims to clarify the recall process, enable citizens to exercise oversight, allow Parliament to protect its integrity, and ensure proper constitutional supervision.
“In other words, where ethics are upheld, the rule of law prevails. Within his constitutional powers, the President is initiating an ethics revolution,” he added.
